Consideration of Items Pulled from the Agenda

Rice= Lake Drawdown Proje= ct

The following items were pulled from the Consent Agend= a.

Regarding Item 3W, Councilmember = Koski mentioned that when this item was originally discussed there was a concern = that it be signed for safety purposes. She suggested this be added to the motion= .

Motion by Councilmember Koski, seconded by Mayor Steffenson, to approve the Ri= ce Lake Drawdown Project for 2002-2003 winter season, subject to the following:

1. The Rice Lake Area Association shall own, operate, maintain, and if necessary, replace an aeration system pursuant to the atta= ched July 23, 2002 Minnesota Department of Natural Resources letter and July 30, 2002 Rice Lake Area Association letter.

2. The Rice Lake Ar= ea Association shall obtain all necessary Minnesota Department of Natural Resources permits and comply with all conditions of said permit.

3. The Rice Lake Area Association shall obtain insuran= ce for the operation of aeration equipment pursuant to the requirements of Section 760:10 Subdivision 6 of the City Ordinance Code.

4. All future Rice Lake Drawdown projects shall be rev= iewed and approved by the City Council.

5. That the documents be signed for safety purposes. <= /p>

Further Discussion

Councilmember Jaeger mentioned the Rice Lake Associati= on was the one who requested permission for the drawdown.

Mayor Steffenson stated th= is is a very productive thing for the City to do and to work with the Association to hopefully solve the problems.

Upon call of the motion by Mayor = Steffenson, there were five ayes and no nays. Motion carried.
